The Texas A&M University System Agreement for Waiver, Indemnification, Assumption of Risk and Medical Treatment Authorization contains the following key points for the reader to pay attention to:
- Voluntary participation: The reader is participating voluntarily in the activity and is aware of the inherent risks involved, including but not limited to illness, injury, and loss of property.
- Hold harmless and indemnity: The reader agrees to release, waive, covenant not to sue, and hold harmless the sponsor and the Texas A&M University System from any liabilities, claims, demands, injuries, or damages that may occur as a result of participation in the activity.
- No insurance coverage: The reader is aware that the sponsor does not maintain any insurance policy covering any circumstance arising from the activity, and it is the reader's responsibility to review their personal insurance coverage.
- Medical authorization, indemnity, and waiver: The reader gives consent for any necessary medical treatment and agrees to indemnify and hold harmless the sponsor for any costs incurred, and release the sponsor from any liabilities, claims, demands, injuries, or damages that may be sustained while receiving medical care.
- Voluntary signature and binding of heirs and assigns: The reader acknowledges and represents that they have read and understood the agreement and sign it voluntarily. For students, it is understood that they can choose not to sign the document and free themselves from its terms by not participating in the activity.
- Exclusions: The waiver does not apply to injuries caused by intentional or grossly negligent conduct.
